2G case: SC seeks CBI reply on quashing charges

The Supreme Court on Tuesday asked CBI to give a ?comprehensive? reply on a number of appeals filed by the 2G spectrum scam accused seeking quashing of the charges against them as the trial in the special CBI court trial has almost reached the final stage.

The accused, which included Reliance Telecom and its three top executives — Gautam Doshi, Surendra Pipara and Hari Nair ? DMK MP Kanimozhi, Swan Telecom promoters Shahid Usman Balwa, contended that they cannot be held liable for the three-year delay in challenging the framing of charges as their petitions in the Delhi High Court was stayed due to the order of the apex court.

While contending that they had immediately moved the court after the charges were framed against them on October 22, 2011, the accused said that they approached the apex court after the latter finally decided that the appeal from the trial court’s order can only be heard by it.

A new bench of justices H L Dattu and K S Radhakrishnan also issued notice to the Centre, the Centre for Public Interest Litigation (CPIL), the NGO on whose PIL the CBI probe was ordered, and Trai.

RTL in its appeal stated that there was enough material and evidence available in the public domain that established that the case against it was ?misconceived and untenable and ought to be quashed.?

RTL said that trial court failed to appreciate that there was no basis for presuming its involvement in any criminal conspiracy since there is no material to indicate agreement or association in a criminal design.

?There is no commonality of purpose, design or economic interest and there is no role, which the petitioner would have fulfilled in the alleged conspiracy. The material on record militates against the complicity of the petitioner in any conspiracy, ? the petition stated.
