The Bombay High Court has ordered eviction of over 60 tenents of a `chawl' here to pave the way for construction of a residential tower there under a redevelopment plan.
A Division Bench of Chief Justice Mohit Shah and Justice A V Mohta gave the direction last week while hearing a petition filed by developers Sumer Corporation.
The realty firm had sought direction to 66 members of the Shakti Chawl Welfare Society in suburban Ghatkopar to vacate their premises to undertake its redevelopment.
According to the company, these persons had refused to vacate the chawl (a group of one or two-room housing units) despite being informed that their land was going to be redeveloped into a residential tower where they will also be allotted aparments.
The Maharashtra Government informed the court that alternative accommodation had been made available to the 66 persons till they are given new houses but they were still unwilling to shift.
The Bench, while accepting the developers and Government's contention observed, "No prejudice is going to be caused to those hutment dwellers, f they are evicted from their present site and the hutments are demolished."
It directed the Deputy Collector of Ghatkopar to issue fresh eviction notices to the occupants, who will have to vacate the premises within three weeks after which the hutments would be demolished.
