The Punjab and Haryana High Court on Monday lifted the stay on toll collection during peak hours (8.30 am to 10 am and 5.30 pm to 7 pm) on the Delhi-Gurgaon Expressway. A division bench headed by Justice S K Mittal asked the private operator to ensure that no traffic snarls take place on the expressway.

Senior lawyer M Sarin, counsel for Delhi Gurgaon Super Connectivity Limited (DGSCL), informed the bench that stopping the U-turn to enter Ambience Mall from 8 am to 11 am and 5pm to 8 pm helped reduce traffic congestion.

The High Court told authorities to ensure that those using the U-turn to enter Ambience Mall are fined. It said the U-turn should only be used by vehicles which intend to turn back.

DGSCL was asked to install signboards to tell motorists that the U-turn was not for vehicles heading to Ambience Mall. This is to ensure that people are not harassed.

A DGSCL spokesperson said the High Court was satisfied with the improvements in the flow of traffic at the Sirhaul toll plaza. We have also been directed to draw a red line 400 metres from the toll plaza on the Delhi side and at the foot of the flyover on the Gurgaon side. In case the queue of vehicles crosses the red line, the boom barriers will be opened to ease the flow of traffic, the spokesperson said.

The High Court criticised Assistant Commissioner of Police (ACP) Ravinder Tomar of the Haryana Police for filing a false affidavit. Tomar had claimed that DGSCL had given a wrong statement before the court about the entry to Ambience Mall. Apologising on behalf of Tomar, Haryana counsel filed a fresh affidavit.

On September 4, the High Court had directed DGSCL to stop collecting toll on the expressway. The stay was later partially lifted as no toll was collected during peak hours.
