GSKCH wins trademark case against Britannia

FMCG company GlaxoSmithKline Consumer Healthcare (GSKCH), makers of the Horlicks brand, has won a legal battle against Britannia Industries, makers of VitaMarie biscuits, in a trademark and copyright violation case filed by BIL for its brand NutriChoice biscuits.

FMCG company GlaxoSmithKline Consumer Healthcare (GSKCH), makers of the Horlicks brand, has won a legal battle against Britannia Industries (BIL), makers of VitaMarie biscuits, in a trademark (NUTRIBIX) and copyright violation case filed by BIL for its brand NutriChoice biscuits.

In an order passed by the Madras High Court, GSKCH has been allowed to restart the marketing and distribution of Horlicks Nutribic biscuits in the market, with immediate effect, according to a statement from GSKCH.

On August 20, GSKCH launched the ?Horlicks Nutribic? in Chennai, which according to BIL is a copy of its NutriChoice Oats biscuits. On noticing GSKCH products in shops in Chennai, BIL immediately approached the Madras High Court, with a stay application.
