HC notice to GNCT on plea against regularisation of illegal

The city government was on Wednesday asked by the Delhi High Court to respond to a plea seeking an order restraining it from taking any decision for regularisation of unauthorised colonies.

Issuing a notice to Delhi government, the Centre and also to the DDA, a division bench of Acting Chief Justice A K Sikri and Justice Rajiv Sahai Endlaw sought their replies by September 6 on a plea seeking restraint order for them from taking any decision to regularise unauthorised colonies here.

The petitioner’s counsel Anil Aggarwal said “this court is yet to decide a plea, filed by an Architect and Town Planner, questioning the Centre, the city government, the DDA’s power to regularise the unauthorised colonies.”

“Restraint all the respondents from making any declaration or pass any order or give any direction regarding regularisation of unauthorised colonies in the NCT of Delhi in any manner and by any means whatsoever during pendency of the petition,” the plea said.

The plea referred to a recent media report in which the Delhi Chief Minister had promised to declare 917 unauthorised colonies as regularised soon.

“In case, the repsondents (governments) succeed in their plans and designs to illegally regularise unauthorised colonies, not only this would perpetuate illegality but will also render the petition largely futile and infructuous and will frustrate the endeavour of the public spirited petitioner,” as per the plea.

The bench fixed September 6 as the next date to hear the matter.
