For denying a claim on insurance amount to a Kajehri resident, the District Consumer Disputes Redressal Froum has levied a penalty of Rs 20,000 on United India Insurance Company.
The forum has also directed the company to pay Rs 7,000 as litigation cost and Rs 43, 864 as the insured value of the complainant’s two-wheeler, which was stolen from the parking area of a lake at Sector 42.
The complainant, Pradeep Kumar’s Honda Activa was stolen when he had gone for a walk around
An FIR was lodged in this regard four days later even though Kumar informed the police the same day.
Even after presenting a Non-Traceable Certificate obtained from the police to the insurance company, his claim was, however, rejected on the pretext that the vehicle was not registered at the time of theft and the FIR was lodged four days later, depriving the police and the company to make efforts to find the vehicle.
However, the repudiation of the claim because of non permanent registration was found to be unjustified and illegal.
Also, the plea of the opposite party with regard to delay in intimation to the police was found unsubstantial as it was duly informed on the same day as shown with the help of an RTI in the forum.
The forum has ordered United Insurance to pay the entire amount within a month.
