The IRCTC has been directed to pay Rs 25,000 as compensation for deficiency in service, harassment, causing inconvenience and litigation expenses to a man who was denied refund of unconfirmed tickets.
The New Delhi District consumer forum has ordered IRCTC (Indian Railway Catering and Tourism Corporation) to compensate Central Delhi resident Subrata Bhaumik who had booked Tatkal tickets online through an agent in November 2010.
On the day of the trip, Bhaumik was informed that the tickets were not confirmed and he had to travel on a bus.
When Bhaumik went to get a refund, he was told that the tickets had been confirmed and he was not eligible for a refund. Bhaumik also told the forum that despite several complaints, he had not received the refund even after two years.
Taking note of the SMS received by Bhaumik from the IRCTC stating that the tickets were not confirmed, the consumer forum held that the service provider was guilty.
“In the present case the TDR was issued on 12.11.2010, the refund applied on 12.11.2010. Till now in 2013, at the time of argument, the complainant has not been returned the fare. This shows the total collapse of the efficiency of Railways for refund of unused tickets,” the forum held.
The forum also noted that IRCTC had informed Bhaumik that no seat was available as the chart had been prepared. However, IRCTC’s reply filed before the forum stated that the tickets were confirmed after the preparation of the chart.
“All this clearly establishes the harassment suffered by the complainant along with others due to a unfair service of Railways,” the consumer forum held.
