The Bombay High Court (HC) Tuesday remarked that it is over a year since actor Jiah Khan’s death and it is about time that a decision on the case is arrived at. While listening to a petition filed by Jiah' Khan's mother Rabya, who has now sought probe by the Central Bureau of Investigation (CBI) into the death, the judges said it is not about “finding faults, but the truth”.
Rabya’s counsel Subhash Jha and lawyer Dinesh Tiwari told Justice V M Kanade and P D Kode that the police had done little to bring out the “real picture”.
Rabya, through her lawyers, told the judges that after the HC’s last order, they met Mumbai Police Commissioner, but were dissatisfied with the composition of the Special Investigation Team as sought by them earlier.
Inclusion of Deputy Commissioner of Police (Zone 9) Chhering Dorje in the SIT was the biggest anxiety, according to Jha. Jiah’s death took place at her residence in Juhu, which fell under Dorje’s jurisdiction. Therefore, Jha submitted that an investigation only by the CBI could bring “facts to light”.
The judges also asked about the concentration of alcohol found in Jiah’s body, after Jha said there was high amount of alcohol in Jiah’s body when she died. The judges were informed that there was 165 mg per 100 ml of blood, and therefore, the judges asked how many units of blood that would mean.
Additional Public Prosecutor, Purnima Kantharia, told the bench that Rabya was carrying out her own “parallel investigation” and the police had done their best in carrying out the investigation.
“It is a very crucial issue,” said Justice Kanade, while adding, “It is not about finding faults. It is about finding the truth.”
“Whatever decision has to be taken; has to be taken quickly. Ultimately, we have to find out the truth,” the judges said. The court also directed Kantharia to produce a short compilation of the investigation done till now and posted the matter on Thursday.
Jiah was found hanging at her residence on June 3, 2013. After her death, Rabya had handed over a letter purportedly written by Sooraj that showed she was in a troubled relationship with him. He was arrested on the charge of abetting her suicide and later granted bail.
