A 22-year-old man was on Thursday sentenced to eight years in prison for kidnapping and raping a neighbour’s 13-year-old daughter in November 2011. The court of Additional Sessions Judge Pawan Kumar Jain sentenced Central Delhi resident Birju alias Mathur to rigorous imprisonment and imposed a fine of Rs 12,000 on him for the offences of rape, kidnapping and criminal intimidation.
The court had earlier directed the Delhi Police to pay a compensation of Rs 25,000 to the girl, after it was established that police had pressurised her to settle the matter instead of lodging an FIR. “Police not only violated the legal rights of the victim and her family by showing disrespect to them, but also violated the legal and human rights of the victim by not lodging the FIR and pressurising her to settle the matter with the accused,” the court had said.
In another case, the special fast-track court of ASJ T R Naval sentenced a man to 10-year rigorous imprisonment for raping his 14-year-old daughter in November 2011. The court held the man guilty on the testimony of the girl and her younger brother. Both testified that their father forcibly shut her mouth and raped her late in the night. Later, the girl fled to a friend’s house and stayed there for five days till her mother returned home.
The mother testified that when she returned from Kolkata, her husband told her that their daughter had “run away” from home. She filed a missing person complaint, after which the child was found at her friend’s house.
