Supertech to move SC, says all rules complied with

He said the company would move the Supreme Court in a week to protect the interests of the homebuyers.

Responding to an Allahabad High Court order to raze two of its under-construction towers in Noida, Supertech CMD RK Arora on Monday claimed the projects fully complied with the rules.

The HC had last week ordered demolition of the twin 40-storied towers at Supertech?s Emerald Court project on a petition filed by the existing residents who claimed irregularities and disruption of air and light.

Arora told FE that the firm was taking legal opinion before moving the SC. ?All steps to protect the interests of customers will be taken.?

Arora said the two controversial towers ? Apex and Ceyane ? had got all necessary approvals and sanctions from the Noida Authority.

The land was allotted by Noida Authority as per a lease deed dated May 16, 2005, and a supplementary deed dated June 21, 2006, he said. The building map got approved on November 26, 2009, and a revised map was approved on March 2, 2012.

Arora said the distance between the two towers was as required by the Noida Building Regulations and Directions, 2010. He denied the charge that the new towers rendered the old block unsafe and blocked light and air.

Meanwhile, hundreds of affected buyers staged protests over the weekend.

The Noida Estate Flat Owners & Members Association (NEFOMA) is helping the buyers to come together and plan the future course of action.

?We will be able to chalk out a strategy in the next 4-5 days ? whether to file a review petition in the Allahabad High Court, to lodge a police complaint, or approach the apex court,? said NEFOMA president Annu Khan.

Last week, a division bench of Justices VK Shukla and Suneet Kumar ordered the demolition ?within a period of four months? of the two towers erected at Sector 93-A, Noida. The complex comprises residential premises and shopping establishments.
